The Site serves as the professional home of Nia Peeples actor, author, singer, dancer, teacher, and spokesperson and provides information about her work, a blog, her books, opportunities to book her for professional engagements, and the ability to sign up for news and updates.

By accessing or using the Site in any way, or by checking a box or clicking a button (such as “Checkout,” “Subscribe,” or “I Agree”) indicating your acceptance, you agree to be bound by these Terms and Conditions (“Terms”) and by our Privacy Policy. If you do not agree, please do not use the Site. We may update these Terms from time to time by posting a revised version here, and your continued use of the Site after changes are posted means you accept them.

2. Intellectual Property

All content on the Site — including text, graphics, logos, photographs, video and audio, blog posts, and the design of the Site itself — is owned by Nia Peeples or used with permission, and is protected by copyright, trademark, and other laws. This includes her books, The Little Apple Tree and Dirty Dancin’ with the Divine: Five Hidden Rhythms of the Body and Soul as One, as well as photographs and promotional materials featuring her name, image, and likeness.

References on the Site to Nia Peeples’ recordings, films, and television work (such as her music and screen roles) are provided for informational and portfolio purposes. Rights in those third-party productions and recordings are held by their respective studios, labels, and rights holders. You may view the Site for personal, non-commercial purposes, but you may not copy, reproduce, republish, distribute, or create derivative works from any Site content, or use Nia Peeples’ name, image, or likeness for commercial purposes, without our prior written permission.

3. Newsletter Sign-Up and User Submissions

The Site allows you to sign up to receive news, book updates, event announcements, and related content. By signing up, you consent to receive these communications, and you may unsubscribe or cancel at any time, using the link in our emails or by contacting us. We handle your information in accordance with our Privacy Policy.

If you submit any material to us — for example, a message through a contact form, a comment, or content shared by email or social media — you represent that you have the right to share it. By submitting such material, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive, sublicensable, and transferable license to use, display, reproduce, modify, and distribute it in connection with Nia Peeples’ work. 4. Books and Purchases

The Site features Nia Peeples’ books, which may be purchased in different ways depending on the title and the stage of a launch: directly through the Site, through our fulfillment or publishing partners, or through third-party retailers (such as Amazon). Whichever applies will be shown to you at the point of purchase. Where a purchase is completed through a third-party retailer or partner platform, that provider’s terms, pricing, shipping, and return policies apply to that purchase, and we are not responsible for their services.

For all purchases connected with the Site, prices and availability are subject to change without notice, we may refuse or cancel any order, and you agree to provide accurate billing and delivery information. During a presale, you are ordering a title in advance of its general release; the expected format, price, and estimated delivery window will be disclosed at the point of purchase, and delivery will follow once the book is available.

5. Shipping

Physical items ordered through the Site are shipped by us or by our fulfillment partner. All purchases of physical items are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (e.g., USPS).

For in-stock items, we aim to dispatch within 1 to 2 business days. Domestic (U.S.) orders are typically sent via USPS, with delivery generally within 5 to 7 business days after dispatch; international orders generally arrive within 7 to 10 business days after dispatch. For presale orders, dispatch begins once the book is released, so delivery follows the release rather than the order date. All delivery times are estimates and are not guaranteed. Orders fulfilled by a third-party retailer are subject to that retailer’s shipping terms.

6. Refunds

For physical products purchased through the Site, you may request a refund within 30 days of receiving your order. For presale orders, you may cancel for a full refund at any time before your order ships. Digital products and any accessed digital content are non-refundable once delivered or accessed. Purchases made through a third-party retailer or partner platform are subject to that provider’s refund policy.

7. Subscriptions, Memberships, and Digital Programs

From time to time, the Site may offer subscriptions, memberships, online courses, master-class materials, or a community program (for example, a membership community associated with a book launch). Where such an offering is made available, by enrolling, you provide your express affirmative consent to any recurring charges disclosed to you at sign-up.

You will receive a post-sale confirmation email upon sign-up, as well as reminders for any annual renewals or free trials exceeding 31 days. You may cancel at any time before your next billing cycle via a clear, online “Click to Cancel” mechanism provided in your account settings or via our contact form. Access to digital or downloaded materials is non-refundable once delivered. The specific terms for each program will be presented at the time you enroll and will govern that program.

8. Booking Inquiries and Professional Services

The Site allows you to inquire about booking Nia Peeples for professional engagements, including acting roles, speaking and keynote appearances, teaching and master classes, spokesperson and endorsement work, music, and collaborations. Submitting an inquiry does not create a binding agreement. All engagements are subject to availability, mutual agreement, and a separate written contract between Nia Peeples (or her management) and the booking party.

9. Blog and Informational Content

The Site includes a blog and other written and video content reflecting Nia Peeples’ personal perspectives on creativity, performance, personal growth, and related themes. This content is offered for general informational and inspirational purposes only. 10. Acceptable Use

• Utilize any content, text, images, or audio from the Site for artificial intelligence (AI) training, machine learning, text and data mining (TDM), or automated web scraping without our express written permission.

We may remove content or suspend access to anyone who violates these Terms, at our discretion.

11. Third-Party Links and Services

The Site links to third-party websites and services, including retailers (such as Amazon), social media platforms, event or ticketing pages, and any payment processor used at checkout. We do not control these third parties and are not responsible for their content, products, policies, or practices. Your dealings with them are solely between you and the third party, and are governed by their terms and privacy policies.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON IT IS COMPLETE OR ACCURATE.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NIA PEEPLES AND HER MANAGEMENT AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR ANY PRODUCTS, SERVICES, OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Nia Peeples, her management, and their affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

14. Copyright Complaints (DMCA)

If you believe content on the Site infringes your copyright, you may send a notice under the Digital Millennium Copyright Act (DMCA) to our designated DMCA Agent, including all information required by 17 U.S.C. § 512(c)(3). We will respond to valid notices, and you may submit a counter-notice if you believe material was removed in error.

15. Termination

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be resolved by binding arbitration in San Diego, California, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Exceptions to this arbitration requirement are claims that qualify for small claims court, which you may pursue there on an individual basis. You and we waive any right to bring or participate in a class or representative action. If any provision of these Terms, including the class action waiver, is found unenforceable, that provision will be severed, and the remaining provisions will stay in full effect.
